1. Who we are and what we do

KG Registration ("KG Registration," "we," "us" or "our") is a privately owned business in San Jose, California that prepares and processes vehicle registration and title transactions on behalf of customers. We are not the California Department of Motor Vehicles. We are not a government agency and are not affiliated with, endorsed by or acting on behalf of the State of California. All registrations, titles, stickers and permits are issued by the DMV under the California Vehicle Code and DMV regulations, and the DMV's rules and decisions govern every transaction.

2. No legal advice

Information on this website and anything our staff tells you is general information about DMV procedures. It is not legal, tax or financial advice. If you have a legal question about ownership, liens, liability, fines or a dispute, consult an attorney.

3. Your responsibilities

• You must be at least 18 years old and legally able to enter into this agreement, or be acting with authority on behalf of a business.
• You are responsible for the accuracy and completeness of every document and piece of information you give us. We rely on what you provide. Providing false information on DMV documents is a crime under California law, and you, not KG Registration, are responsible for the consequences.
• You confirm you have the legal right to request the transaction, for example that you own the vehicle or are authorized by the owner or your employer.
• You agree to bring the documents required for your transaction. If the DMV requires additional documents, inspections, smog certificates, VIN verifications or signatures, the transaction cannot be completed until you provide them.

4. Fees and payment

• Two kinds of fees. The DMV sets registration, title, use tax, penalty and other state fees, and those are paid to the DMV through us. KG Registration charges a separate service fee for preparing and processing your transaction. We will tell you both amounts before you pay.
• Estimates. Any fee amount quoted by phone, text or on this website is an estimate until the DMV calculates the final amount at processing. Late penalties, use tax and prior unpaid fees can change the total.
• Refunds. Once a transaction has been submitted to the DMV, DMV fees are not refundable by us and our service fee is earned. If we cannot submit a transaction because of something on our side, we will refund our service fee. Refund requests for DMV fees must be made to the DMV under its rules.
• Returned payments. Dishonored checks or reversed card payments may be charged the maximum fee allowed under California Civil Code section 1719, and the DMV may cancel the transaction.

5. What we cannot promise

We will prepare and submit your transaction carefully and promptly. We cannot promise that the DMV will approve it, how long the DMV will take, or that a hold, stop, suspension or other issue in DMV records will be cleared, because those decisions belong to the DMV. "Same-day" and "instant" refer to transactions that are complete and approved at the time of processing; some transactions require DMV review and take longer.

6. Phone, text and email communications

When you call, text or submit a form, you agree that we may contact you by phone, text message or email about your request. Text messages are transactional; reply STOP to opt out at any time and HELP for help. Message and data rates may apply. Our use of your information is described in our Privacy Policy, which is part of these Terms.

7. Using this website

• The content, design, logo and text on this website belong to KG Registration or its licensors. You may view and print pages for your personal, non-commercial use. You may not copy, republish or use our name or logo without written permission.
• You agree not to misuse the site, submit false or abusive requests, scrape content, attempt to gain unauthorized access, or interfere with its operation.
• Our site links to third-party services such as Google Maps and social networks. We are not responsible for their content or privacy practices.

8. Disclaimer of warranties

The website is provided "as is" and "as available." To the fullest extent permitted by California law, KG Registration disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement, regarding the website. Nothing in these Terms limits warranties or rights that cannot be waived under California consumer-protection law.

9. Limitation of liability

To the fullest extent permitted by law, KG Registration's total liability to you for any claim arising out of our services or this website is limited to the service fee you paid to us for the transaction in question. We are not liable for indirect, incidental, special or consequential damages, including lost time, towing, impound, citations, penalties or lost income, that result from DMV decisions, DMV delays, inaccurate information you provided, or events outside our reasonable control. Some jurisdictions do not allow certain limitations, so some of these limits may not apply to you.

10. Indemnification

You agree to defend and hold harmless KG Registration and its owners and staff from claims, fines and costs, including reasonable attorney fees, that arise from false or incomplete information you provided, from your violation of these Terms, or from your violation of any law in connection with a transaction you asked us to process.

11. Governing law and disputes

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Any dispute that cannot be resolved by talking to us first will be brought in the state or federal courts located in Santa Clara County, California, and you consent to their jurisdiction. Either party may bring a qualifying claim in small claims court. California residents may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210.

12. Changes to these Terms

We may update these Terms from time to time. The effective date at the top shows the current version. Changes apply to services requested after the change is posted. Continued use of the website after a change means you accept the updated Terms.

13. General

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. These Terms, together with the Privacy Policy, are the entire agreement between you and KG Registration regarding the website and our services, except for any written service agreement you sign at our office, which controls for that transaction.
